J&J Hip Patients Will Take 'Bellwether' Lawsuits To Trial

Recipients of Johnson & Johnson (JNJ) (JNJ) hip implants recalled by the company will start going to trial later this year to help determine liability and damages in more than 6,000 lawsuits, lawyers said today.
J&J’s DePuy unit recalled its 93,000 ASR hips worldwide in 2010, including 37,000 in the U.S., saying more than 12 percent of the devices failed within five years. Lawsuits in federal and state courts describe patients in pain and immobilized by joint dislocations, infections and bone fractures.
Lawyers for patients and J&J, the world’s second-largest health-care company, met with a judge overseeing the so-called multi-district litigation in 4,200 federal lawsuits. Another 2,000 are in state courts. Both sides are negotiating a way to choose suitable plaintiffs to help resolve whether J&J bears blame and how much each case could be worth, lawyers said.

There are several cases wherein patients experience so much pain after a hip replacement surgery. One reason is a defective hip device. In 2010, Johnson&Johnson issued a worldwide recall of two hip replacement devices (manufactured by its subsidiary DePuy Orthopaedics) because of hip replacement problems. These devices are the ASR XL Acetabular System and the ASR Hip Resurfacing System. The company cited early failure of the devices, resulting in approximately one out of eight patients’ requiring a “revision surgery." This surgery is often more difficult and painful than the original hip replacement procedure. This website provides a wide-ranging information on this.
Hip replacement surgery is not a new procedure, but when new products are rushed to the market without testing them properly problems tend to happen. When these products are medical devices that suppose to last tens of years but patients start to experience problems only after a few years it is clear that those devices needed more testing before the release. The worst part is what patients had to endure after the implants started to fail on them, not after 20 years, but only after a few years of use. These patients have the right to claim compensation for the suffering they had to endure and with the lawsuits against the manufacturer moving forward they are one step closer to getting justice.
It‘s the health authorities that should handle the pressure. They should meticulously examine these medical devices before approving it for release. I learned from some articles online which says that the manufacturers never did enough clinical tests to confirm the product’s efficacy.
By the way, I learned that having a revision surgery is very dangerous as well so we must first consult our doctor and learn its possible effects.
Most of the victims also consult attorneys about their situation and if is there something that they can do about it. In fact, hundreds of lawsuits - including DePuy Pinnacle lawsuits - were already being filed before the court by the victims to compensate from the damages that they had suffered, which I think is a good move.
I suggest that all of those who are implanted with hip devices must visit their doctors to avoid more complications.
