Jim Gottstein's Law Project for Psychiatric Rights (PsychRights.org) has gone to court to stop the drugging of Alaska's children. Before they are given psychiatric drugs, Jim wants the following standards to be met:

(1) That proven psychosocial interventions have been exhausted.
(2) That the benefits of the drug outweigh the risks.
(3) That those authorizing the prescriptions are fully informed about the risks and benefits, and the alternatives.
(4) That the children are thoroughly monitored, including for side effects.

There is nothing radical or in your face about Jim's attempt to require the state of Alaska to use science and common sense before drugging the children in its care, usually for the mere convenience of their keepers. A sane society would bar the state from giving psychiatric drugs to any children under any circumstances. Their brains are growing--and should not be made to develop in a toxic internal environment. Instead of psychiatric drugs, they need what all children need--more and better attention from caring adults, improved family life, and better schooling. And they need protection from people who would give them drugs!"

The new bill would create More FDA, a whole NEW BRANCH of FDA, to regulate tobacco.

It's being sold as a measure to keep kids from smoking, which on the surface looks great, BUT:

We Already Have a Federal Agency specifically tasked with tobacco related issues. It's called ATF: Bureau of Alcohol, Tobacco and Firearms.

Chantix from Pfizer was FDA allowed onto the market to save lives from tobacco induced cancer. See Pharmalot from Oct. '08.
"The drug accounted for more reported serious injuries than any other prescription drug for a second quarter, a total of 1001 new cases, including 50 additional deaths. Earlier this year, the FDA warned that Chantix may be linked to psychiatric problems, including suicidal behavior and vivid dreams, and the government banned it for pilots."

2001: Child Psychiatrists & Sexual Boundary Violations

Hang on to your lunch, because it may want to rocket up and out when you discover the idea of Rehabilitation concerning Psychiatrists and their "Violation of Sexual Boundaries" with patients.

In March 2001 the American Journal of Psychiatry identified some of their problems.

Psychiatrists Disciplined by a State Medical Board
James Morrison, M.D., and Theodore Morrison, M.P.H.

OBJECTIVE: This study determined the risk of discipline by a medical board for psychiatrists relative to other physicians and assessed the contributions to such risk. METHOD: Physicians disciplined by the California Medical Board in a 30-month period were compared with matched groups of nondisciplined physicians. RESULTS: Among 584 disciplined physicians, there were 75 (12.8%) psychiatrists, nearly twice the number of psychiatrists among nondisciplined physicians.

The disciplined group included significantly more psychiatrists who claimed child psychiatry as their first or second specialty and significantly fewer psychoanalysts. CONCLUSIONS: Organized psychiatry has an *obligation to address sexual contact with patients and other causes for medical board discipline.

Dehlendorf and Wolfe (7) reported that child specialists were disciplined for sex-related offenses to about the same extent as were other psychiatrists, whereas in our study they were nearly three times more at risk.

Antipsychotics = Assault With A Deadly Weapon: 2 Face Charges In California

3 Arrested In Nursing Home Deaths In Lake Isabella
"In an elder abuse case described by one investigator as the most outrageous he has ever seen, three former top managers at a Kern County nursing home have been arrested in the deaths of three residents who allegedly were given needless doses of psychotropic medications.

The state attorney general's office contended in a criminal complaint that more than 20 residents at a skilled nursing center run by the Kern Valley Healthcare District were drugged "for staff convenience." Many of them experienced side effects that included dramatic weight loss, slurred speech, tremors, loss of cognition and even psychosis, according to the complaint.

Arraignment is scheduled this morning for the center's one-time medical director, Dr. Hoshang M. Pormir, former nursing director Gwen D. Hughes and former chief pharmacist Debbi C. Hayes. They were jailed in Bakersfield on Wednesday.

"These people maliciously violated the trust of their patients by holding them down and forcibly administering psychotropic medications if they dared to question their care," state Atty. Gen. Jerry Brown said.

All three have been charged with elder abuse. Hughes and Hayes, who are accused of administering shots by force and without consent, also face charges of assault with a deadly weapon.

The complaint paints a bleak picture of a facility dominated by nursing director Hughes, 55, who is accused of seeking to drug all but the most docile residents. Medical director Pormir, 48, allegedly rubber-stamped Hughes' orders for medication, failed to examine patients and was "either willfully or naively ignorant" of his proper role, according to the complaint. Pharmacist Hayes, 51, told investigators that she went along because Hughes had wide experience in psychiatric hospitals, the complaint says.

Hughes had been fired from a convalescent home in Fresno in 1999 for allegedly overmedicating patients there, according to state officials.", .....

The Miami Herald reports (below) that in a letter to doctors, Janssen Pharmacia, manufacturer of the highly promoted drug, Risperdal (risperidone), admitted "misleading doctors and other healthcare providers about the safety of its product, minimizing potentially deadly side effects." As late as Nov. 10, 2003, Janssen claimed Risperdal did not increase the risk of diabetes among consumers--when the company knew the opposite was true.

"The drug, Risperdal, has been commonly prescribed to Florida children in state care, including to a handful of boys who developed lactating breasts after taking it."

Circuit Judge John A. Frusciante, said Risperdal continues to be used frequently by doctors who treat children in state care. ''It is not uncommon,'' he said, noting:

"This whole psychotropic drug issue is a problem for us. It's a very scary area to be in, because we know medication can be a tremendous help for a number of children. But we also know that there are risks to the children who are taking these medications.'' , ..... ,

"1. One in every 145 patients who entered the trials died, and yet those deaths were never mentioned in the scientific literature.

2. The trials were structured to favor the Atypicals and most of the study reports were discounted by the FDA as being biased.

3. One in every thirty-five patients in Risperdal trials experienced a serious adverse event, defined by the FDA as a life threatening event or one that required hospitalization.

4. Twenty-two percent of patients in Zyprexa trials suffered serious adverse events

5. The Atypicals did not demonstrate superior effectiveness or safety over Typical antipsychotics.

It is important to note that a drug company does not have to prove that a new drug is safer or more effective than an old drug to gain FDA approval. Essentially, the manufacturer has to demonstrate that the drug is proved to yield better results than placebo in a statistically significant number of patients in short-term trials (6-8 weeks). "

"What is Hogan’s personal stance on mental health screening? He would have preferred universal mental health screenings for the population, but he has stated that "science and public opinion" have not advanced to the point where universal mental health screening is acceptable. Hogan has expressed his frustration that implementations of the NFC recommendations have not proceeded faster. He "conceded that 'we in the field' would have an easier time convincing the public of the need for at least broader, if not universal, screening if the CMHS (Center for Mental Health Services) had published the NFC Action Plan that has been delayed." CMHS is the federal agency within the U.S. Substance Abuse and Mental Health Services Administration (SAMHSA) that is charged with the efforts to implement the recommendations of the NFC.

Drugging Babies in Ohio—$65.5 million for kids' mental health drugs

In a Columbus Dispatch article dated April 25, 2005, the headlines read, “EVEN BABIES GETTING TREATED AS MENTALLY ILL; Prescriptions on the rise even though they haven't been tested on children”.

The Dispatch reported, “Nearly 40,000 Ohio children on Medicaid were taking drugs for anxiety, depression, delusions, hyperactivity and violent behavior as of July [2004]. For the entire year, the Ohio Department of Job and Family Services paid out about $65.5 million for kids' mental-health drugs.” They also reported that 696 Ohio children, ages newborn to 3 years old, received sedatives and powerful, mood-altering, mental-health drugs through Medicaid in July of 2004."

Mr Hogan was then singled out for Another State with 'Incurably Mentally Ill' kids, ...... to get Them the 'Mental Health' They need.

The New York State Senate unanimously confirmed Michael F. Hogan, PhD, as Commissioner of the New York State Office of Mental Health (OMH) on Wednesday, March 14, 2007. The Senate also confirmed Diana Jones Ritter as Commissioner of Mental Retardation and Developmental Disabilities, and David J. Swarts as Commissioner of Motor Vehicles.

Prior to joining OMH earlier this year, Dr. Hogan served as Director of the Ohio Department of Mental Health, a position he held since March 1991. He previously was director of the Connecticut Department of Mental Health from 1987-1991.

Dr. Hogan chaired the President’s New Freedom Commission on Mental Health in 2002-2003. He has co-authored a book and several national reports, and written over 50 journal articles or book chapters.

In 2006, he was received a Special Leadership Award at the first national meeting of the Campaign for Mental Health Reform, and the SPAN USA Allies for Action Award from the Suicide Prevention Action Network.

A graduate of Cornell University, Dr. Hogan has also received an M.S. from the State University College at Brockport, and a Ph.D. from Syracuse University."

FORMER HOSPITAL OWNER ARRESTED IN KICKBACK SCHEME
THAT DEFRAUDED GOVERNMENT HEALTH CARE PROGRAMS
THROUGH UNNECESSARY TREATMENTS TO HOMELESS

The former co-owner of a Los Angeles-area hospital was arrested this morning on federal charges of paying illegal kickbacks as part of a scheme to defraud Medicare and Medi-Cal by recruiting homeless persons from Los Angeles’ Skid Row.

Robert Bourseau, 74, who maintains residences in Rancho Mirage and downtown Los Angeles, a former co-owner and top executive at City of Angels Medical Center, was arrested this morning without incident at his Los Angeles loft by federal authorities. Bourseau is expected to make his initial court appearance this afternoon in United States District Court in Los Angeles.

Bourseau and Dante Nicholson, a former City of Angels vice-president, were indicted under seal yesterday by a federal grand in Los Angeles. Also named in the indictment was Intercare Health Systems, the company through which Bourseau and his partner, Rudra Sabaratnam, operated City of Angels. The 12-count indictment, which was unsealed this morning following Bourseau’s arrest, alleges that Intercare, Bourseau, Nicholson and others conspired to recruit homeless people to receive unnecessary health services for the purpose of committing health care fraud.

Nicholson, 51, of Palmdale, will be summoned to appear for an arraignment in federal court in Los Angeles next month.

This is the second indictment brought in the investigation into health care fraud related to Skid Row residents. Last month, Sabaratnam, 64, pleaded guilty to paying illegal kickbacks for patient referrals (see: http://www.usdoj.gov/usao/cac/pressroom/pr2008/153.html). Sabaratnam’s co-defendant, Estill Mitts, 64, of Los Angeles, who operated a center that recruited homeless people to receive unnecessary health services, pleaded guilty in September 2008 to conspiracy to commit health care fraud, money laundering, and tax evasion (see: http://www.usdoj.gov/usao/cac/pressroom/pr2008/121.html). Sabaratnum is scheduled to be sentenced on June 8, and Mitts is scheduled to be sentenced on March 16, both by United States District Judge George H. King.

If convicted of the 12 counts in the indictment, both Bourseau and Nicholson would face maximum potential sentences of 65 years in prison. If convicted, Intercare could be fined as much as $6 million in fines.

An indictment contains allegations that a defendant has committed a crime. Every defendant is presumed innocent unless proven guilty in court.

The indictment unsealed today against Intercare, Bourseau and Nicholson is part of an ongoing investigation being conducted by the U.S. Department of Health and Human Services, Office of Inspector General; the Federal Bureau of Investigation; IRS-Criminal Investigation Division; the California Department of Justice Bureau of Medi-Cal Fraud and Elder Abuse; and the Health and Law Enforcement Team (HALT), a multi-agency task force which is operated by the Los Angeles County Health Department.

Advocacy groups decry rising costs of health care

Recent reports by several advocacy groups illustrate the trouble many are facing given the current economic climate, combined with continued increases in health care costs.

A Universal Health Care Action Network of Ohio study found that Franklin County families making between 200 percent and 300 percent of the federal poverty level (between $42,400 and $63,600 for a family of four) did not have enough money left over after paying basic living expenses to afford health care or insurance costs (Source: “Even middle class strapped by health-care costs, advocacy group says,” Columbus Dispatch, Jan. 14, 2009).

Those without a job are in even more trouble, according to a national study by Families USA that includes Ohio-specific data (Source: “Health costs rising with unemployment,” Columbus Dispatch, Jan. 15, 2008). That study found that COBRA premiums would use up most of an average Ohio unemployment check. The average monthly cost for COBRA in Ohio is $1,030, yet the average monthly unemployment check is $1,327.

I have recently had several opportunities on various news programs to discuss the economy and what is wrong with the so-called economic stimulus package. I have said over and over what we shouldn’t be doing, and now I’d like to explain what we should be doing.


But to improve the situation, you must first have a solid grasp of how we got here. Government policies and central planning created the housing bubble, now going bust. About a decade ago the government made expanded homeownership and affordable housing a public goal. Through Fannie Mae, Freddie Mac and the secondary mortgage market the government incentivized creative, low down-payment, more widely available mortgage products, and discouraged the market-proven lending standards of the past. The Federal Reserve kept interest rates artificially low, which added more fuel to this fire. Many related sectors temporarily flourished because of this, and many people got into homes they otherwise could not have afforded. The increased demand for housing sent prices soaring until in many markets housing became even more unaffordable, necessitating even more creative mortgages, and impossibly leveraging homeowners. Many risky investment vehicles such as mortgage-backed securities, derivatives, credit default swaps grew out of this unsustainable situation. As the foreclosures began, the house of cards started to tumble. Too many people have confused the symptoms and the pain of the bust with the problematic policies that caused the bubble, which is really what needs to be treated.


First of all, just as the best cure for a hangover is not to drink so much, the best cure for a recession is a recession. It is time to sober up and return to free market sanity, risk and reward, supply and demand, without political intervention. Politicians are good at catering to the needs of special interests, but very bad at determining what needs to take place in the market. Government should stick to punishing fraud and enforcing contracts. When they use the tax code, bureaucratic departments and their manipulative rules and regulations to dictate social and economic behavior, we end up with distortions and malinvestments. Bailing out banks, continuing failed Fed policies and strapping the taxpayer with toxic debt will worsen the pain, and punish the innocent.


If Congress really wanted to do something helpful, it would cut taxes. Ideally, we would repeal the income tax altogether and get the IRS off the economy’s back, which would be a huge boon. We should also cut spending. Cut every unconstitutional department and program, every wasteful governmental encroachment on the people’s liberty and money, starting with our massive overseas empire. The cost of our empire is bringing us to our knees, just as the Soviets’ empire did to them. Congress should also abolish the Federal Reserve and take back its responsibilities to ensure sound money, safe from the manipulations of powerful banking interests.


These things would constitute real change, real economic stimulus. The plans being bandied about Washington are just more of the same. As long as no one seriously considers the cure, we are unfortunately destined to prolong the disease.
