Judge Lets Gorsky Off The Hook In Risperdal Case
CEO will not have to face a jury in case where 17-year-old boy allegedly grew breasts after taking Risperdal

Johnson & Johnson ($JNJ) CEO Alex Gorsky has again dodged a bullet and will not be forced to testify in front of a jury in the somewhat sensational Risperdal case in which a teenage boy allegedly grew breasts after taking the antipsychotic drug.
Gorsky has already given a deposition in the case. The judge overseeing it waited to the end to make his decision, since the trial is set to begin Monday.
J&J lawyers argued that Gorsky was too far up the food chain to have firsthand knowledge of the events. But the Philadelphia Inquirer reports that defense attorneys have a memo in which he approved a $500,000 payment to a doctor in 2002 to begin a program at Massachusetts General Hospital with the aim of upping the use of Risperdal for children even though it was approved for adults only at the time.
In an earlier case brought by the same plaintiff's lawyers, and alleging a similar side effect of the drug, J&J settled just before the case went to trial. The settlement also came before the judge decided whether the CEO would have to face a jury and explain why the company was pushing the drug on children when it wasn't approved for that use. Still, with hundreds of individual suits still out to be tried or settled, there may be many more shots at Gorsky.

The fact that this Risperdal fiasco has gone on This long speaks volumes of the endless Conflicts of Interest plaguing our Government.
Mr Gorsky owes the World an explanation of his previous hair splitting between a J&J In House Off-Label Marketing plan to sell this drug to children years before acquiring FDA approval to Market it to children, and an Off the Premises mutation of his Ideations RE: a Selling plan, to Market or not Market this drug to the prescribers who poisoned children with it.

And while Mr. Gorsky may continue to dance his way around the stand for some time yet, others, in this conflicted mess, will have the Voters to answer to in just a few weeks.

Rep. Darrell Issa (R-CA), chair of the House Oversight Committee, has come out firing today after reports about collusion between the Department of Justice and far-left propaganda machine Media Matters for America. The reports showed that DOJ officials and Media Matters were trading information about particular conservatives, including Breitbart News editor Joel Pollak. “Not since Richard Nixon have we seen a president who puts together an enemies list and has a whole team pursuing it,” said Issa today. “That’s what’s happened in this administration. It’s sad. It’s not the America I want to see going forward. I sincerely hope that after the election, regardless, the American people will have made a statement that they won’t tolerate this.”
Issa also suggested that Congress look at whether Media Matters be able to keep its nonpartisan tax exempt status under current law. Furthermore, said Issa, DOJ Office of Public Affairs Director Trace Schmaler, who worked with Media Matters, should be fired. “These people represent the culture that President Obama brought in to Washington,” he said. “A culture of division; a culture that embraces the concept that the 1 percent is evil and somehow the rest of America somehow needs to punish the 1 percent.”
