The Trump administration switched sides Wednesday in a case pending before the Supreme Court that could retroactively nullify tens of thousands of agency decisions.
The case, Lucia v. SEC, has major implications for the process by which federal agencies try or punish those in violation of laws or regulations.
The litigation concerns an agency’s decision to allow career bureaucrats to preside as the functional equivalent of judges during enforcement proceedings. These officials, called administrative law judges (ALJs), are hired by career bureaucrats. They are not appointed by the president, a court or an agency head, but they exercise significant authority on behalf of the U.S. government in official proceedings.
ALJs can, among other things, issue subpoenas, make decisions about the credibility of witnesses or the admissibility of evidence, and issues provisional rulings that are generally upheld on final review — if a final review occurs at all.
The Constitution requires that the president, the courts, or the head of an executive department appoint all “inferior officers” of the United States.
A group of investment managers challenged the Securities and Exchange Commission’s (SEC) use of ALJs in an enforcement proceeding convened against them for alleged violations of securities law. The managers argue these proceedings are unlawful, because the ALJs are exactly the sort of “inferior officer” who must be appointed by the president, the court, or the head of an agency, since they exercise meaningful discretion on behalf of the federal government.
A lower federal court, the U.S. Court of Appeals for the D.C. Circuit, found in favor of the SEC. A three-judge panel found for the SEC, and the full court affirmed that decision on a five to five vote. The investment managers then appealed to the Supreme Court.
The Obama Justice Department sided with the SEC in the dispute, but Trump’s new solicitor general, Noel Francisco, changed positions Wednesday, and backed the money managers.
“Upon further consideration, and in light of the implications for the exercise of executive power under Article II, the government is now of the view that such ALJs are officers because they exercise ‘significant authority pursuant to the laws of the United States,'” Francisco wrote in a new brief at the Supreme Court.
A Supreme Court ruling against the SEC could have important implications for similarly-situated officials in other agencies. ALJs often preside in actions brought by a whole host of federal agencies. A finding against the SEC would potentially jeopardize, and perhaps invalidate, the legal status of thousands of other agency proceedings.
The Justice Department generally represents federal agencies before the high court. Accordingly, the solicitor general asked the justices to appoint another lawyer to represent the SEC as the litigation continues.
The high court could decide to take the case as soon as January.

Rabbi Abraham Cooper, the associate dean of the Simon Wiesenthal Center, told The Jerusalem Post on Tuesday, “Germans, more than any other people in Europe, should understand what starts with the Jews never ends with the Jews. When I raised the issue brought to Germany by many Arab and Muslim immigrants with the German justice minister, I was told this issue would be dealt with in the context of the German authorities’ efforts to integrate newcomers into German life and values.”
He added, “The German authorities, Church leadership and NGOs have a moral obligation to ensure 21st century German Jews will never have to hide their Jewish identities on the streets of Germany.”
Cooper said that he has not heard of any government efforts to rope in antisemitism among Muslim communities in the Federal Republic since his 2014 meeting with the justice minister.
The news outlet Radio Bochum first reported that a representative of the community said members will stop wearing kippot in public because they are routinely faced with insults on public streets when they are recognized as Jews.
“Muslim youths attacked people of the Jewish faith,” the segment said.
Bochum is an industrial city in the state of North Rhine-Westphalia with a population of nearly 365,000. Bochum’s Jewish community, which includes the towns of Herne and Hattingen, numbers over 1,000.
Esther Schapira, a German journalist and expert in the field of modern antisemitism, tweeted on Tuesday, “It is often the small [news] items, in which the scandal is hidden, which for most people is not a scandal: Antisemitism in everyday life.”
Schapira along with the journalist Georg M. Hafner wrote one of the authoritative books on contemporary antisemitism in Germany, titled Israel is Blamed for Everything: Why the Jewish state is so hated.
Commenting on the Radio Bochum story, Ali Utlu, a Turkish ex-Muslim activist in Germany, sent a tweet to his over 19,000 followers, stating: “What a disgrace 72 years after the Shoah.”
Bochum has been a hotspot for anti-Israel hatred. In 2014, some 120 activists marched to Bochum’s city hall chanting “Israel, child murderers” and “Allahu Akbar.” The anti-Israel demonstrators protested Israel’s war to stop the Islamic organization Hamas’s rocket attacks on Israeli territory.
Starting in 1941, most of Bochum’s Jews were murdered by the Nazis in Theresienstadt and Auschwitz.

Arguing that "White-supremacist capitalism" is responsible for "state-sanctioned violence against Black people," the Black Xmas website urges people to patronize black businesses "rather than lining the pockets of Trump."
A California State University-Los Angeles professor is urging Americans to participate in a “Black Xmas” by divesting from “white corporations” and fighting “White Capitalism.”
In her op-ed for The Los Angeles Sentinel, Melina Abdullah, a Black Lives Matter activist and the chair of the school’s Department of Pan-African Studies, explains that “Black Xmas” is “an economic divestment from White corporations and an investment in building Black community through support for Black community organizations and businesses.”

Alongside general information, the organization also touts a list of “black businesses” around the country, and urges Americans to donate to a list of “black organizations,” including Black Lives Matter.
“Black Lives Matter is dreaming of and building for a #BlackXMas, where we divest from White corporations and invest in building Black community,” Abdullah writes in her op-ed. “Rather than lining the pockets of Trump and other White-supremacist capitalists, donate to Black-led organizations that are building new, liberatory structures in our communities.”

It is no secret that federal health programs are
growing at an unwieldy and ultimately cataclysmic rate. ObamaCare,
Medicaid expansion, growing entitlements and new mandates are all
contributing to the unchecked expansion of government controlled health
care and the increasing liability for taxpayers.
In simple terms, the solution is to
institute policies that will allow free-market principles to foster an
environment where the individual patient is empowered just as customers
are in virtually every other market. Such a market would allow consumers
to choose medical care and insurance based on value and cost, rather
than allow market participants and providers to rig the system to reap
windfall profits due to government patronage.
This consolidation of medical services at the expense of patients shockingly underscores what government intrusion ultimately means for health care – less access, fewer choices and increased costs for patients, and taxpayers.

One patient got a $3,660 bill for a 4-mile ride. Another was charged $8,460 for a trip from one hospital that could not handle his case to another that could. Still another found herself marooned at an out-of-network hospital, where she’d been taken by ambulance without her consent.
These patients all took ambulances in emergencies and got slammed with unexpected bills. Public outrage has erupted over surprise medical bills — generally out-of-network charges that a patient did not expect or could not control — prompting 21 states to pass laws protecting consumers in some situations. But these laws largely ignore ground ambulance rides, which can leave patients stuck with hundreds or even thousands of dollars in bills, with few options for recourse, finds a Kaiser Health News review of 350 consumer complaints in 32 states.
Patients usually choose to go to the doctor, but they are vulnerable when they call 911 — or get into an ambulance. The dispatcher picks the ambulance crew, which, in turn, often picks the hospital. Moreover, many ambulances are not summoned by patients. Instead, the crew arrives at the scene having heard about an accident on a scanner, or because police or a bystander called 911.
Betsy Imholz, special projects director at the Consumers Union, which has collected over 700 patient stories about surprise medical bills, said at least a quarter concern ambulances.

Here are ways to steer clear of exorbitant ambulance bills.
Forty years ago, most ambulances were free for patients, provided by volunteers or town fire departments using taxpayer money, said Jay Fitch, president of Fitch & Associates, an emergency services consulting firm. Today, ambulances are increasingly run by private companies and venture capital firms. Ambulance providers now often charge by the mile and sometimes for each “service,” like providing oxygen. If the ambulance is staffed by paramedics rather than emergency medical technicians, that will result in a higher charge — even if the patient didn’t need paramedic-level services. Charges range widely from zero to thousands of dollars, depending on billing practices.
The core of the problem is that ambulance and private insurance companies often can’t agree on a fair price, so the ambulance service doesn’t join the insurance network. That leaves patients stuck in the middle with out-of-network charges that are not negotiated, Imholz said.
This happens to patients frequently, according to one recent study of over half a million ambulance trips taken by patients with private insurance in 2014. The study found that 26 percent of these trips were billed on an out-of-network basis.
That figure is “quite jarring,” said Loren Adler, associate director for the USC-Brookings Schaeffer Initiative and co-author of recent research on surprise billing.
The KHN review of complaints revealed two common scenarios leaving patients in debt: First, patients get in an ambulance after a 911 call. Second, an ambulance transfers them between hospitals. In both scenarios, patients later learn the fee is much higher because the ambulance was out-of-network, and after their insurer pays what it deems fair, they get a surprise bill for the balance, also known as a “balance bill.”
