NC Will Get $38.8 Million From J&J As Part Of Medicaide Fraud Settlement

Drugmaker Johnson & Johnson will pay North Carolina $38.8 million as part of a $1.2 billion multistate settlement to resolve allegations that the company improperly marketed some drugs, resulting in Medicaid fraud.

North Carolina’s share of the settlement will fund Medicaid with the civil penalties going to public schools, according to a statement from the North Carolina attorney general’s office announcing the settlement.

The states alleged that Johnson & Johnson and its subsidiary Janssen Pharmaceuticals, both based in New Jersey, marketed anti-psychotic drugs Risperdal and Invega for uses not approved by the Food and Drug Administration, including to treat elderly dementia patients and hyperactive children. The allegations included making misleading statements about the safety of the two drugs and, in the case of Risperdal, paying kickbacks to health care professions who promoted or prescribed the drug to children or the elderly.

Subcontractor Working On ObamaCare Website Under FBI Investigation

One of the subcontractors working on the Obamacare website is currently under investigation by the Federal Bureau of Investigation.

Client Network Services Incorporated (CNSI) became a sub-contractor on the Obamacare website in 2012, working hand in hand with QSSI, according to its website. QSSI was one of several contractors hauled before Congress to address the sites troubled rollout in October.

According to Department of Health and Human Services (HHS) “war room” notes released in October, CNSI was responsible for assisting with electronic data interchange (EDI) — defined as a system to transfer data between computer systems without human interaction.

Taxpayers have spent $200 million to establish the network for the Affordable Care Act in Hawaii – $53 million on just the Hawaii Health Connector web site development and management alone.
However, so far, just 257 individuals have secured healthcare through the exchange.
Some 113 employers submitted applications though the exchange, but have not yet selected plan.
Connector Deputy Executive Director Eric Alborg released the numbers for the first time at a Hawaii Health Connector board meeting on Friday.
Despite repeated requests from the media, Hawaii was among the last three states to disclose these figures.
While Hawaii Health Connector executives were hoping to reach a 300,000 enrollment over the next couple of years, and at least sign up the 100,000 people without any medical coverage in Hawaii, critics say the numbers have been dismal.
The current cost breakdown is about $778,000 in federal funds for each individual who successfully signed up for healthcare.

Blue Cross and Blue Shield of North Carolina said Tuesday that it will raise rates as much as 24 percent on 2013 individual health insurance plans that are being extended next year.
The increase is double the price inflation for the same health plans just a year ago, but many Blue Cross customers who have grumbled about rising costs in past years are cheering the news this time.
The health plans in question were slated for elimination under the Affordable Care Act, the nation’s health care law, but Blue Cross said last week it would offer the plans next year. President Barack Obama urged insurers to extend the individual plans for one year amid a public outcry over forced cancellations and steep price increases for replacement plans.
The N.C. Department of Insurance will review the proposed rates and, if it determines they are too high, it could order Blue Cross to issue refunds to customers. The agency has not set a deadline to review the proposed rates, which go into effect Jan. 1.
“The key thing is – this is one more year,” said Blue Cross spokeswoman Michelle Douglas. “It’s not saying you can keep this plan forever.”

President Obama told a gathering of business executives on Tuesday that the federal government was not “lavishly spending” on social programs.

“What we know is, is that our — our fiscal problems are not short-term deficits. Our discretionary budget, that portion of the federal budget that isn’t defense or Social Security or Medicare or Medicaid, the entitlement programs, is at its smallest level in my lifetime, probably since Dwight Eisenhower.

“We are not lavishly spending on a whole bunch of social programs out there,” Obama continued. “And in many ways, a lot of these programs have become more efficient and pretty effective,” he added.

"Uh-Oh." O'care Site Crashes On Sebelius At News Conference

The troubled HealthCare.Gov website crashed in front of Health and Human Services Secretary Kathleen Sebelius on Tuesday in Miami.

HHS said in a statement the issue was resolved quickly. “As we continue to make improvements to the site, we know that there will be sporadic outages form time to time, as was the case Tuesday," a spokesperson told The Hill in an email.

"This issue was resolved quickly. HealthCare.gov is improving every day. We have completed more than 200 items from our punch list of fixes, reduced page load times from 8 seconds to less than 1, and error rates are down from six percent to less than one percent. We expect that the site will be working smoothly for the vast majority of users by the end of the month.”

A local CBS reporter jumped in while Sebelius was doing a test run on the site to say, “the screen says 'I’m sorry but the system is temporarily down.' ”

“Uh oh,” Sebelius responded.

The secretary held events in Orlando and Miami on Tuesday encouraging people to sign up for healthcare despite the problems the administration has had in getting the website up and running.

Senate Majority Leader Harry Reid (D-Nev.) announced Tuesday that he is looking at reforming Senate rules to prevent Republicans from filibustering President Obama’s judicial nominees.
“I’m at the point where we need to do something to allow government to function,” Reid said when asked if he would consider using the so-called nuclear option, a controversial procedural tactic for changing Senate rules. “I’m considering looking at the rules.”
The seldom-used tactic would allow Democrats to change the Senate’s rules with a simple-majority vote.

As Bloomberg reports, it's the second case over Topamax-related birth defects to go to trial--and the second loss for J&J. Last month, a jury awarded $4 million to Virginia mother April Czimmer, who alleged that Janssen didn't do enough to publicize Topamax's links to cleft lip and palate. Janssen says it will appeal both verdicts.

Overall, J&J faces more than 130 cases linking Topamax to birth defects, now consolidated in Philadelphia court. The two decisions so far came in bellwether cases selected to be tried first. Two other cases are scheduled to hit court in February and March.

According to the plaintiffs, Janssen knew that Topamax could trigger birth defects for years before truly warning the public. The risks showed up in animal studies, and then in reports about the children of Topamax patients, Powell's lawyer said during the trial.

But Janssen's lawyers maintained that the rates of cleft lip and cleft palate in Topamax patients mirrored the rates of those injuries in the overall population, Bloomberg reports. The FDA asked Janssen to change Topamax's label in 2011, to warn of data showing that the drug might contribute to cleft lips and cleft palates in babies born to mothers using the medicine.

J&J has been fighting a raft of litigation related to its other products as well. Most recently, the company was said to agree to pay $4 billion to wrap up lawsuits over faulty hip-replacement devices. And earlier this month, J&J wrapped up a longstanding off-label marketing probe by the Department of Justice, with $2.2 billion in civil and criminal penalties.

RAND PAUL: I’m still learning about it. It’s 20,000 pages of regulations. The Bill was 2,000 pages and I didn’t realize this until this week, the whole idea of you losing or getting your insurance cancelled wasn’t in the original Obamacare. It was a regulation written by President Obama, three months later.
So we had a vote, this is before I got up there. The Republicans had a vote to try to cancel that regulation so you couldn’t be cancelled, to grandfather everybody in. You know what the vote was? Straight party line. Every Democrat voted to keep the rule that cancels your insurance.

At least 250 lawsuits involving Johnson & Johnson’s improper marketing of Risperdal are pending in Pennsylvania’s Philadelphia Court of Common Pleas, according to information provided by a law firm involved in the litigation.  The firm, which represents individuals who may have developed gynecomastia (male breast growth) as a result of the drug, alleges that the unapproved use of Risperdal to treat ADHD is also on the rise.
